1. Acceptance of Terms

By using Nady Social, you agree to these Terms of Service, our Privacy Policy, and any additional terms that may apply.

2. Use of Services

You may use our social content creation and editing services only in compliance with these Terms and all applicable laws. You must be at least 18 years old or have parental consent to use our platform and purchase subscriptions.

3. User Accounts

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and password.

4. Content Ownership

You retain full ownership of all content you upload and all final deliverables we create for you. By uploading, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the content creation service.

5. Prohibited Use

You agree not to use the service to:

• Upload or share unlawful, harmful, or offensive content.
• Infringe on the intellectual property rights of others.
• Request content that violates platform guidelines of social media networks.
• Attempt to reverse engineer or disrupt our platform.

6. Intellectual Property

All content and software associated with Nady Social (excluding user content and deliverables) are owned by or licensed to Nady Social and are protected by copyright and other laws.

7. Termination

We reserve the right to suspend or terminate your access to the services at our discretion and without notice if you violate these Terms.

8. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind. We do not guarantee that the services will be error-free or uninterrupted.

9. Limitation of Liability

To the fullest extent permitted by law, Nady Social shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the services.

10. Modifications

We may update these Terms from time to time. Continued use of the services after changes implies acceptance.

11. Payments & Subscriptions

All payments are processed securely by our third-party payment processor Stripe, a PCI-DSS Level 1 certified service provider. Charges are displayed in euros (EUR) unless otherwise stated. By purchasing a subscription you authorise us (and Stripe on our behalf) to charge your selected payment method for the applicable amount, including any taxes. Services are activated upon successful payment.

12. Refunds & Cancellations

Refund Policy: You may request a refund within fourteen (14) days of your initial subscription purchase, provided that no content has been delivered. To request a refund, email support@ndy.social from the address associated with your account. Approved refunds are credited to the original payment method within five (5) to ten (10) business days.

Once content delivery has begun, you expressly waive your statutory right of withdrawal for that billing period.

Cancellation Policy: You may cancel your subscription at any time via your account dashboard or by contacting support. The subscription will remain active until the end of the current billing period. No partial refunds are provided for unused time within a billing period.

13. Chargebacks & Disputes

If you initiate a chargeback or payment dispute, we may suspend your account until the matter is resolved. We reserve the right to contest any illegitimate chargebacks and to recover any associated fees.

14. Security & Payment Processing

We do not store complete credit-card numbers or CVC codes on our servers. All payment information is transmitted directly to Stripe via industry-standard encryption. You acknowledge and agree that Stripe is solely responsible for the security of your payment data.

15. Indemnification

You agree to indemnify and hold harmless Nady Social and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of or related to (i) your violation of these Terms, (ii) the content you upload, or (iii) your misuse of the services.

16. Changes to Pricing or Billing

We may modify our prices or billing structure at any time. Any changes will become effective at the start of the next billing cycle following notice to you via email or through the service.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Austria, and you agree to submit to the exclusive jurisdiction of the courts of Vienna, Austria.
